Data center expansion faces rising regulatory pressure across APAC

Regulatory scrutiny, resulting from governmental responses to AI, cloud and data, is complicating data center development and expansion in the region.

Data center development across the Asia Pacific region is entering a more constrained and complex regulatory phase, as governments respond to the rapid expansion of artificial intelligence, cloud services and digital infrastructure, and the strain on underlying resources needed to meet demand.

Power and water usage approval are two of the most significant regulatory hurdles for developers to address with any data center project. Across the region, governments are increasingly focused on the strain data centers place on existing infrastructure, particularly electricity and water, and how best to protect these while supporting continued investment.

On power, the primary issue is the growing pressure on grid capacity and the need to protect supply within state-owned utilities.

Water usage and cooling requirements of data centers are also a key consideration across Australia and Southeast Asia in particular. In some parts of the region, development approvals have been delayed when water scarcity cannot be adequately addressed by data center sponsors and operators.

This focus on resource use is driving stronger environmental regulation. Governments are introducing detailed frameworks for environmental impact assessment and sustainability, with water usage and energy efficiency becoming central components of approval processes.

Policy shifts

In Australia, for instance, recent policy developments reinforce this shift. The federal government’s national interest framework for data centers and AI infrastructure, together with state-based initiatives such as the NSW Data Center Consultation Paper, signal a more active approach to managing the sector’s growth.

These frameworks place greater emphasis on aligning projects with national and state priorities, including energy transition, water use, infrastructure capacity and local economic outcomes. The frameworks appear to be placeholders for future regulation and legislation.

As a result, government approvals for data center development are becoming more selective. While governments continue to recognize the economic importance of data center investment and the role of digital infrastructure in supporting AI and broader economic growth, there is increasing scrutiny on how projects impact local resources and communities.

This is contributing to more structured approval processes, where access to power and water, as well as alignment with policy objectives, are central considerations.

Beyond regulation, developers continue to face practical challenges in delivering projects. Constrained power access, planning approvals, skilled labor shortages and long equipment lead times are contributing to delays in bringing new facilities online. These challenges are driving changes in how data centers are designed and delivered.

Responding to the shifts

In turn, developers can better plan and adopt more renewable and sustainable power and water usage by aligning implementation of sustainable resource usage with the more certain build program.

For regional investors and operators across the industry, it is paramount to stay abreast with the regulatory environment. Laws, government policy and AI infrastructure frameworks are under constant scrutiny and change across the region.

While governments continue to compete for investment in hyperscale data center projects, there has been a marked increase in the difficulty of obtaining approvals, particularly where projects cannot demonstrate alignment with sustainability and resource management requirements.

This reflects a broader trend across the region. Governments are seeking to balance the economic benefits of data center investment with the need to protect critical infrastructure and natural resources.

The drive to marry data center development as a resource-intensive asset and significant infrastructure against sustainability is a trend to monitor. Governments are looking to ensure the investment and infrastructure is adopted, with AI usage booming, while concurrently ensuring sustainable practices and local resources are best protected by regulation.

As the sector continues to expand, the key challenge for developers, investors and regulators will be managing this intersection between growth, infrastructure capacity and environmental constraints.

Projects that can demonstrate efficient use of power and water and sustainable practices, alignment with regulatory expectations, and flexibility in delivery, are likely to be better positioned to progress in an increasingly competitive and constrained approvals environment.
